Faulty Goods Claims

When you purchase goods, you are entitled to expect that they are safe, fit for purpose and free from defects. Unfortunately, faults in design, manufacture or instructions can result in products causing injury, property damage or financial loss.

At Aston Knight Solicitors, we specialise in faulty goods claims, helping individuals recover compensation where defective products have caused harm. We act against manufacturers, importers, distributors and retailers, ensuring those responsible are held accountable.

What Is a Faulty Goods Claim?

A faulty goods claim arises when a product is unsafe or defective and causes injury, damage or loss. Claims may be brought under:

  • The Consumer Protection Act 1987
  • The Consumer Rights Act 2015
  • Common law negligence

You do not need to prove that the manufacturer or supplier intended to cause harm, only that the product was defective and that the defect caused your injury or loss.

Importantly, you do not need to be the purchaser of the product. If you were injured by a faulty item, you may still be entitled to compensation.

Common Causes of Faulty Goods Claims

Defects can occur at different stages of production and sale, including:

  • Design faults making the product inherently unsafe
  • Manufacturing errors or poor-quality materials
  • Inadequate safety warnings or instructions
  • Failure to meet UK or EU safety standards
  • Products not fit for their intended purpose

Manufacturers cannot exclude liability for injury through terms and conditions, even though this is sometimes attempted.

Case Study

Faulty Goods Claim

Our client, Mr D, suffered serious hand burns after using a newly purchased domestic electrical appliance that malfunctioned during normal use. The product overheated due to a manufacturing defect, despite being used in accordance with the manufacturer’s instructions.

Aston Knight Solicitors obtained expert engineering evidence confirming that the product failed to meet safety standards. A claim was pursued against the importer under the Consumer Protection Act 1987.

Following negotiations, a settlement was secured to compensate Mr D for his injuries, loss of earnings, and ongoing symptoms.
