£120,000 for a knee injury at work

Ms V suffered a serious knee injury when she was assaulted at work by her male colleague. At the time of her accident, Ms V was at her place of work when she was assaulted by her male colleague. Her assailant undertook a form of martial arts manoeuvre on her during which she was flipped over and thrown to the ground.

As a result of the assault, our client sustained a serious leg injury requiring surgery and suffered psychological injury.

A claim was brought against our client’s employer alleging her employer was vicariously liable for the actions of her colleague as the assault occurred in the workplace. Liability was accepted by the defendant insurers and medical evidence was obtained. The case was issued at court and a settlement was reached in the sum of £120,000.

Emma Pearce commented: “These types of claims are notoriously difficult but are not ones that cannot be won. Our experience of these types of claims are that many clients are at first hesitant whether or not to bring a claim. The concerns mainly being how it may affect the working relationship. For this client bringing the claim facilitated her getting early rehabilitation and the compensation assisted her with getting the treatment she required.”
